TERMS AND CONDITIONS OF THE STORE EcuSale - AUTO-ELEKTRONIKA DAMIAN SOSNOWSKI

§1
General Provisions

 

The online store EcuSale - AUTO-ELEKTRONIKA DAMIAN SOSNOWSKI conducts retail sales via the Internet based on these Terms and Conditions.

Upon purchase, the terms and conditions become an integral part of the sales agreement concluded with the Customer.

 

The condition for concluding a sales agreement is the Customer's acceptance of the Terms and Conditions.

 

The prices displayed in the Store are gross prices (including VAT of 23%).

 

The goods available in the Store are free from physical and legal defects.

§2
Orders

 

Orders can be placed in the following ways:
a) via the form available on the Store's website,
b) by email to the address available on the Store's website,
c) by phone at the numbers designated for placing orders, available on the Store's website in the Contact tab.

 

A condition for order fulfillment is the provision of data by the Customer that allows for customer verification. The Store confirms the acceptance of the order by email or phone. The Store reserves the right to refuse to accept an order, limit the payment methods, or require prepayment if the order raises justified doubts about the authenticity and reliability of the provided data or the method of payment.

 

The information contained on the Store's website regarding the purchased goods at the time of placing the order is binding for both parties, in particular: price, product characteristics, its features, components included in the set, delivery time, and method.

 

The information on the Store's website does not constitute an offer within the meaning of the Civil Code. By placing an order, the Customer makes an offer to purchase a specific product. A sales agreement is concluded at the moment the payment for the Customer's order is credited.

§3
Payments

 

The Customer has the choice of payment methods specified in the Payment Methods tab.

  The store supports payment cards: Visa and MasterCard.
The entity providing payment card support: Visa and MasterCard is PayPro S.A.
 

Shipping costs are specified in the delivery price list.

 

A condition for sending the goods is the payment for the goods and shipment being credited.

§4
Shipping of Goods

 

The ordered goods are shipped by courier companies or made available for collection by the customer at the company’s premises.

The goods are sent in express mode to all European Union countries and worldwide, except Russia and Belarus. Delivery costs and times are described in the product offers and depend on the destination and the choice of courier service.

 

In the case of payment by credit card, the order fulfillment time is counted from the moment of positive transaction authorization.

 

In the case of payment in any way other than cash on delivery, the shipping time is extended by the period between the order placement and the date of crediting the amount to the Store's bank account.

§5
Complaints

 

The basis for accepting a complaint is the presentation by the Customer of proof of purchase of the goods (receipt or VAT invoice).

Warranty for new parts: The warranty for new parts is provided for a period of 2 years from the date of purchase. In the event of manufacturing defects or damage resulting from the manufacturer's fault, the customer has the right to replace the part with a new one or to receive a refund in accordance with applicable regulations.

Warranty for used parts: The warranty for used parts is provided for a period of 6 months from the date of purchase. The warranty covers hidden defects that occurred as a result of normal use of the part. In the event of a defect, the customer has the right to make a complaint in accordance with the terms of the warranty.
 

2. In the event of non-conformity of the goods with the contract, the Customer should return the complained goods to the Store together with a description of the non-conformity and a complaint letter to the address

The Store will respond to the Customer's complaint within 14 working days from the moment the goods are returned along with the description of the non-compliance. If verifying the non-compliance requires obtaining an expert opinion or that of the product's manufacturer, the time for the Store to respond will be extended by the time it takes to obtain such an opinion.

 

If fulfilling a justified complaint involves sending the Customer new goods or rectifying the non-compliance, the delivery costs are borne by the Store.

 

Individual settings of the Customer's computer and monitor that cause incorrect or distorted display of product information (e.g., colors) cannot be the basis for a complaint.

§6
Right of Withdrawal

 

Under the Act on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product of March 2, 2000, the Customer has the right to withdraw from the contract.

 

The right of withdrawal is effective if the Customer submits a statement of withdrawal from the contract to the Store within 14 days of receiving the goods.

 

The Customer returns the goods to the Store within 14 days of submitting the statement of withdrawal from the contract. The returned goods should be in an unblemished condition, complete, in the original packaging, and should not show signs of use. The shipping costs are borne by the Customer.

 

In the case of returning an electronic or electrical component with broken warranty seals, the buyer bears the cost of rechecking the goods amounting to 40 euros. (breaking the warranty seal means the product has been used) and may result in the refusal to accept the product, and the goods will not be eligible for return, and the Store will not refund the amount paid by the Customer.

 

Within 3 working days of receiving the shipment, the Store will check the condition of the returned product.

 

Within 7 days of checking the goods, the Store will refund the Customer the paid amount excluding shipping costs. The Customer should indicate the bank account number to which the refund should be transferred. If payment was made by credit card, the refund will be made to the card.

 

If the Customer violates the conditions specified in paragraphs 2 and 3 above, the statement of withdrawal from the contract is ineffective, the goods are not eligible for return, and the Store does not refund the amount paid by the Customer.

 

The right of withdrawal does not apply to the Customer in the cases specified in Art. 10(3) of the act specified in paragraph 1 above, namely in the scope of:
a) provision of services commenced, with the Customer's consent, before the expiration of the withdrawal period (applies to cases of service provision, not the sale of goods),
b) audio and visual recordings and those recorded on data carriers after the Customer has removed their original packaging,
c) contracts for services for which the price or remuneration depends solely on fluctuations in the financial market,
d) services with properties specified by the Customer in their order or closely related to them,
e) services that due to their nature cannot be returned or whose subject matter deteriorates quickly,
f) delivery of newspapers,
g) services related to gambling.

 

The Seller reserves the right to withdraw from the concluded sales agreement in cases of:

lack of goods at the current time.

verification of non-compliance of the goods with the description of the offer regarding the technical condition of the goods and the visual condition resulting from time and storage conditions.

§7
Privacy Protection

 

By placing an order, the Customer consents to the processing of their personal data solely for the purpose of fulfilling the order.

 

The Customer may also express a separate consent to receive promotional materials from the Store, including a commercial newsletter.

 

The Customer has the right to access their data and correct it, as well as to request its deletion.

 

In accordance with Art. 24(1) of the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws 2002 No. 101, item 926 as amended), we inform you that the Administrator of your personal data is EcuSale. The Data Administrator ensures that the principles adopted in this privacy policy guarantee all users of the service the exercise of rights resulting from the Act of August 29, 1997 on the Protection of Personal Data (Journal of Laws 2002 No. 101, item 926, as amended), in particular the right to access their own data, the right to request updates and deletions of data, and the right to object in cases specified in this act.

§8
Intellectual Property

The use of any materials published on the Store's website (including photos and product descriptions) without the written consent of the Store is prohibited.

§9
Entry into Force and Amendments to the Terms and Conditions

 

The Terms and Conditions come into force on the day of publication on the Store's website.

 

The Store reserves the right to amend the Terms and Conditions, which come into effect on the day of their publication on the Store's website. The version of the Terms and Conditions applicable to contracts concluded before the amendment shall be the version in force at the time of the Customer's order placement.
